Explanation
An administrator could not direct all distance learning faculty to show a video clip on "being a successful on-line student" at the beginning of each class unless permission to show the clip had been obtained from the copyright holder.
While the administrtor could argue that "anything in the classroom is done under the supervision of the instructor," the teach act would not apply because the administrator is not the instructor for the class in which the video clip be used.
Furthermore, even if an instructor agreed that the video clip would be valuable for students to watch, distributing the video clip on-line would not comply with the TEACH Act unless the clip was an integral part of the class and was directly related to the course objectives.
